1. Acceptance & Overview

These Terms of Service (the “Terms”) govern your access to and use of Cloudzor.Host products, including game servers, the control panel, and related services (collectively, the “Service”). By creating an account, placing an order, or using the Service, you agree to these Terms and all referenced policies (AUP, Privacy, SLA). If you do not agree, do not use the Service.

2. Eligibility & Accounts

  • You must be at least 13 years old (or the minimum age in your jurisdiction). If under 18, you confirm parental consent.
  • You are responsible for your account credentials, security, and all activity under your account.
  • You must provide accurate information and keep billing/contact details up to date.
  • We may refuse, suspend, or terminate accounts for violations or risk of harm.

3. Orders, Activation & Trials

  • Orders are offers to purchase Services. Activation occurs once payment is confirmed.
  • Provisioning is typically automated. Some orders may require manual review to prevent fraud or abuse.
  • Trials or promotional credits may be limited and can be revoked for misuse or policy violations.

4. Billing, Renewals & Taxes

  • Services renew automatically each billing cycle unless cancelled prior to renewal.
  • Prices are shown before applicable taxes/fees, which you are responsible for where required by law.
  • Upgrades may be prorated; downgrades generally take effect on the next term.
  • Invoices must be paid by the due date. Late/non-payment may lead to suspension and data deletion after a grace period.

5. Refunds & Cancellations

We offer a fair-use refund policy for first-time orders within a limited period if the Service cannot be delivered as advertised and our support team is unable to resolve the issue. Abuse, violations, and changes of mind are not eligible. To cancel, use the client area before the next renewal date.

6. Acceptable Use Policy (AUP)

You agree not to use the Service for illegal activities or to harm networks, systems, or users.

  • No malware, phishing, doxing, spamming, or harassment.
  • No infringement, pirated content, or unlawful distribution.
  • No intentionally abusive workloads (e.g., crypto mining, unfettered stress testing) unless expressly allowed.
  • No evasion of DDoS protections, scanning, or unauthorized access to third parties.
  • Comply with game EULAs and third-party terms (e.g., Mojang/Microsoft policies).

7. Fair-Use & Resource Limits

  • Each plan includes a fair allocation of CPU, RAM, storage, and bandwidth suitable for typical gameplay.
  • Excessive or abusive usage that negatively impacts node stability may be throttled, sandboxed, or migrated.
  • We may request optimization (e.g., reducing view distance, removing heavy plugins) to preserve performance for all customers.

8. Customer Content & Licensing

You retain ownership of your worlds, configs, and data. You grant us a limited license to host, store, back up, and transmit your content solely to operate the Service. You represent that your content and use comply with applicable laws and rights.

9. Intellectual Property

The Cloudzor.Host platform, brand, and panel features are protected by IP laws. You may not copy, reverse engineer, resell, or create derivative works of the Service except as permitted by law or by written permission.

10. Mods, Plugins & Third-Party Software

  • We provide tools to install third-party mods/plugins/modpacks, which remain subject to their own licenses.
  • Compatibility and stability vary by version; you are responsible for ensuring legal usage and backups.
  • We are not liable for issues caused by third-party software, but our support will assist on a best-effort basis.

11. Security & Data Protection

  • Always-on DDoS mitigation and role-based access for subusers.
  • SFTP for file transfers; rotate credentials when staff changes.
  • We handle personal data per our Privacy Policy.

12. Availability, SLA & Maintenance

We target 99.9% monthly uptime. See our separate SLA for credits and details. Scheduled maintenance (typically off-peak) and factors outside our control are excluded from downtime calculations.

13. Support & Changes

  • Support is available via tickets and, where offered, Discord.
  • We may improve, change, or discontinue non-core features with notice where practical.

14. Suspension & Termination

  • We may suspend or terminate for AUP/ToS violations, legal requests, fraud risk, or security threats.
  • Upon termination, your right to use the Service ceases; we may retain data as required by law or policy.

15. Chargebacks & Non-Payment

Initiating a chargeback without contacting support may result in immediate suspension and fee recovery. We will work with you to resolve billing disputes in good faith.

16. Disclaimers & Liability

  • The Service is provided “as is” and “as available” except where expressly stated.
  • We are not liable for indirect, incidental, special, or consequential damages, lost profits, or data loss.
  • Our aggregate liability is limited to fees paid for the affected Service during the 3 months prior to the event.

17. Governing Law & Disputes

These Terms are governed by the laws of our operating jurisdiction, without regard to conflict-of-law principles. Disputes will be first addressed via support; if unresolved, the parties agree to good-faith negotiations and, where applicable, binding arbitration or the competent courts of that jurisdiction.

18. Changes to These Terms

We may update these Terms to reflect product changes or legal requirements. Updates become effective upon posting. Material changes will be announced in advance when feasible. Continued use after the effective date constitutes acceptance.
